Retail Applications Warranty
We pride ourselves on building the best battery available in the world today,
and we support this with the simplest and most comprehensive warranty in the
business. We talk the talk, but we also walk the walk. We are sure that
our batteries will perform, but should there be a problem, this is how we
warranty our product.
Corvus Energy (the company) warrants the batteries sold by it or its agents as
free of defects in workmanship and material at the time they are shipped from
the company's
ENERGY STORAGE MODULE
HYBRID POWER SYSTEM factory.
Customers must perform at the time of receipt an inspection of goods noting the
state of arrival of the goods before signing a delivery slip or receipt of
goods in good order. Any defects in packaging must be noted and reported to
the shipping company at the time of receipt. The Company is not responsible
for damaged product reported after shipment has been signed "received in good
condition". All shipments should be thoroughly inspected for direct and
indirect damage before receipt.
The company will replace or, at its option, repair any Corvus Energy battery
sold by it that fails to conform to the warranty stated above on a NO CHARGE
BASIS as follows:
Failure within 60 months from the date placed in service yields FREE
REPLACEMENT, not including shipping, handling or freight charges from the
factory to the applicable destination. After the first 60 months of service,
defective batteries will be adjusted for a period of up to 120 months prorated
from the date first in service at prices in effect at time of adjustment.
To gain a warranty on Corvus Energy batteries, Corvus Energy may at its
discretion require engineering approval of the installation and use of the
batteries. This will be determined within the purchase order for the batteries
and associated systems. Failure to allow Corvus Energy to approve the
application and installation will void any warranties implied or associated.
To claim a manufacturing warranty, proof of purchase must be presented, showing
the date of purchase and the battery's serial number. The battery must be
tested by an authorized battery outlet for actual defect, and upon confirmation
of the defect, the warranty will be administered. Warranty is limited to first
time buyers unless transfer of warranty has been applied for within one week of
transfer. There is a service and handling fee for warranty transfer, and
Corvus Energy withholds the right to re-certify the installation at the cost of
the onwards owner in order to grant transfer of warranty.
Warranty Limitation and Exclusions
The foregoing warranty constitutes Corvus Energy's exclusive liability and the
exclusive remedy for any breach of or any other nonconformity of the products
covered by this warranty. Corvus Energy makes no warranty, expressed or
implied or statutory, including, without limitation, any warranty of
merchantability or fitness for a particular purpose. No representative,
employee, distributor or dealer of Corvus Energy has the authority to make or
imply any warranty representation, promise or agreement, which in any way
varies the terms of this limited lifetime warranty. The Corvus Energy products
sold to customer are intended to be used only in the application specified by
customer to Corvus Energy. Any other use renders the limited lifetime
warranty expressed herein and all implied warranties null and void and same are
hereby excluded. Under no circumstances shall Corvus Energy be liable to
customer or any third party for consequential, incidental, indirect, exemplary,
special or other damages whether in an action based on contract, tort
(including negligence) or any other legal theory, arising out of or related to
the products sold to customer, including but not limited to lost profits or
loss of business, even if Corvus Energy is apprised of the likelihood of such
damages occurring.
This limited lifetime warranty may not be changed, modified, limited or
extended in scope except by a written agreement signed by a director of Corvus
Energy and customer. Except as stated, any purported modification of this
limited warranty shall be null and void.
The company makes no warranty with respect to its batteries other than the
warranty stated above. All implied or expressed and implied warranties of any
other kind are hereby excluded.
